• We provided legal support in the process of building a new retail park in Ursus.
• We supported a German car manufacturer in connection with the construction of an electric car factory.
• We advised in connection with a joint venture for the construction of a warehouse and logistics centre, as well as on land acquisitions for warehouses.
• We supported a Polish residential developer in connection with the construction and sale of a turnkey building to the Housing for Rent Fund (PRS sector).
• We helped to obtain a favourable zoning decision for the expansion of a factory in the Piaseczno municipality (won court case)
• We drew up a tailor-made guarantee agreement for the exploitation of geothermal resources for a hotel in Poland.
• We carried out the process of dividing agricultural land into plots for a single-family housing estate.

JUDICIAL AND ADMINISTRATIVE PROCEEDINGS

• We have successfully represented our clients in a number of land use and spatial planning court cases, for example: ▪ We won a precedent-setting court case concerning the invalidation of a zoning study relating to a multi-billion dollar mix-used development; ▪ We won a case that led to the annulment of an unfavourable zoning decision allowing the extension of one of the factories in a suburb of Warsaw.
• We have carried out a number of cases concerning building permits or legalisation of unauthorised construction, e.g. we obtained for an investor the invalidation of a building permit issued 21 years ago in order to allow the client to extend a commercial building.
• We have won a number of court proceedings relating to construction contracts, including after withdrawal from the contract and demands for payment of liquidated damages.
• We successfully represented our client in litigation concerning breach of a hotel purchase agreement, including rescission and enforcement of contractual penalties.
• We have represented developers in numerous court cases, including successful cases concerning perpetual usufruct (precedent-setting change in the fee rate), won cases concerning abusive clauses in development contracts, disputes with housing associations and subcontractors, and represented in an architectural design copyright dispute.
• We obtained a precedent-setting judgment in a case involving claims by former owners of a Warsaw real estate located in the centre of Warsaw (Bierut Decree).
• We have experience in cases before arbitration courts involving claims by foreign investors against the Republic of Poland under bilateral investment treaties (BITs).

REAL ESTATE TRANSACTIONS

• We advised a foreign investor in connection with an investment involving renowned brands such as Radisson and Holiday Inn.
• We advised the French fund in connection with the sale and leaseback of three hotels in Poland, including negotiating the partnership agreement, the hotel management agreement, the leaseback agreement and the title risk insurance policy.
• We supported a Spanish real estate group in connection with the acquisition of a shopping centre in a joint venture with a global investment fund.
• We assisted with the sale of the completed building to the PRS fund.
• We advised a foreign investor in relation to an investment in a new PET recycling plant in Poland.
• We adviced in relation to a complex contribution of chicken farms and agricultural land.

LEASE AGREEMENTS

• We have provided legal services to four shopping malls of over 100,000 GLA in respect of all lease agreements and other contracts related to the operation of these centres.
• We negotiated an agreement for sublease of premises in a prestigious office building with the CPK company.
• We have drafted a number of legal opinions on lease agreements for leading global fashion brands e.g. INDITEX.
• We negotiated a number of lease agreements for office space in Poland for a British fund.

COMMERCIAL CONTRACTS

• We are experienced in handling the day-to-day legal affairs of commercial companies, including the preparation and negotiation of all contacts within the activities of real estate, automotive or logistics companies.
• We are experienced in the preparation and negotiation of all contracts concluded in the course of the operation of shopping centres.
• We have negotiated contracts for logistics services, storage of goods in warehouses.
• We provided legal services to Jaguar and Land Rover dealers.
• We have applied INCOTERMS in the international freight transport contract. We are experianced in private international law and the Vienna Convention on the Sale of Goods (CISG).
