Maciej Machlejd comments on the changes to the regulations on city-centre development rules in the Rzeczpospolita daily:
“An investor can no longer invoke a previously obtained zoning decision indicating that the land is subject to the possibility of applying the parameters of city-centre specific development rules. After the amendment of the technical conditions, only the provisions of the zoning plan or zoning study may be invoked. This means that if there is no local plan and the applicable zoning study of Warsaw does not explicitly provide for the city-center development area, the investor has a plot of land on which development is significantly impeded, says attorney-at-law Maciej Machlejd. – The only solution for investors is to initiate a complicated procedure for a derogation from technical conditions. Under this procedure, investments in the vicinity of the Daszyńskiego roundabout are already being built, he adds”.
